GENERAL TERMS AND CONDITIONS OF SALE

These general terms and conditions of sale (hereinafter, the "General Terms") shall apply to all purchases made by an internet user/individual (hereinafter, the "CUSTOMER") on the website www.phonecomponente.com (hereinafter, the "WEBSITE") from:

Any order placed on the WEBSITE implies the CUSTOMER’s unconditional acceptance of these General Terms.


Article 1. Definitions

The terms used below shall have the following meaning in these General Terms:

  • "CUSTOMER": Refers to the SELLER’s co-contracting party, who guarantees they qualify as a consumer as defined by Spanish law and jurisprudence. It is expressly stipulated that the CUSTOMER acts outside any usual or commercial activity.

  • "DELIVERY": Refers to the first delivery of the PRODUCTS ordered by the CUSTOMER to the delivery address specified in the order.

  • "PRODUCTS": Refers to all products available on the WEBSITE.

  • "TERRITORY": Refers to SPAIN.

Article 2. Purpose

These General Terms govern the sale of PRODUCTS by the SELLER to its CUSTOMERS.

The CUSTOMER is clearly informed and acknowledges that the WEBSITE is intended for consumers and that professionals must contact the SELLER’s sales department to benefit from specific contractual conditions.

If the CUSTOMER does not accept these terms and conditions, they are requested to refrain from using the WEBSITE.

Article 3. Acceptance of the General Terms

The CUSTOMER agrees to read these General Terms carefully and accepts them before proceeding to pay for the order of PRODUCTS on the WEBSITE.

These General Terms are accessible via a link at the bottom of each page of the WEBSITE and must be reviewed before placing an order. The CUSTOMER is encouraged to read, download, print, and retain a copy.

The SELLER advises the CUSTOMER to review the General Terms when placing a new order, as the latest version shall apply to each order.

By clicking the first button to place the order and the second to confirm it, the CUSTOMER acknowledges having read, understood, and accepted the General Terms without reservation.

Article 4. Purchase of Products on the WEBSITE

To purchase any PRODUCT, the CUSTOMER must:

  • Be at least 18 years old and have legal capacity (or, if a minor, provide proof of parental consent).

  • Provide necessary identification information by completing the form on the WEBSITE. Fields marked with (*) are mandatory.

  • Ensure all provided information is accurate and up to date.

The CUSTOMER may track their order status on the WEBSITE. Delivery tracking may also be available via certain carriers. The CUSTOMER may contact the SELLER’s sales department at Comercial@phonecomponente.com for order updates.

The SELLER reserves the right to request identity verification.

Article 5. Orders

5.1 Product Specifications

The SELLER will present PRODUCT features as clearly as possible (via information files on the WEBSITE). The CUSTOMER must review this information before ordering.

All PRODUCTS sold are new and comply with EU and Spanish regulations unless stated otherwise.

5.2 Order Procedure

  1. Product Selection: The CUSTOMER selects PRODUCTS, adds them to the cart, and checks the order summary.

  2. Checkout: The CUSTOMER verifies billing/delivery details and selects a payment method.

  3. Order Confirmation: An acknowledgment is displayed on the WEBSITE and emailed to the CUSTOMER.

  4. Billing: The invoice is included with the delivered PRODUCTS.

5.3 Order Date

The order date is when the SELLER confirms receipt. Delivery timelines begin from this date.

5.4 Pricing

Prices are in EUR (tax included). Shipping costs vary based on weight, destination, and carrier.

VAT rates are applied as per Spanish law. Prices may change due to supplier adjustments or promotions.

5.5 Product Availability

The SELLER uses a "just-in-time" stock system. If a PRODUCT is unavailable, the SELLER may:

  • Deliver available items first and ship the rest later.

  • Propose a substitute of equivalent quality/price.

  • Refund unavailable items within 30 days.

Article 6. Right of Withdrawal

The withdrawal policy is detailed in Annex 1 (accessible via hyperlink on the WEBSITE).

Article 7. Payment

7.1 Payment Methods

The CUSTOMER may pay online via methods offered by the SELLER. Payment data is securely processed by the bank.

7.2 Payment Date

  • For credit card payments, the account is debited upon order confirmation.

  • For partial deliveries, the full amount is debited when the first shipment is sent.

7.3 Payment Issues

If payment fails, the CUSTOMER must contact customer service to arrange an alternative method. Unpaid orders will be canceled.

Article 8. Proof and Archiving

Contracts exceeding €120 (tax included) are archived for 5 years.

Article 9. Transfer of Ownership

Ownership transfers to the CUSTOMER upon full payment.

Article 10. Delivery

Delivery terms are outlined in Annex 2.

Article 11. Packaging

PRODUCTS are packed per transport regulations. The CUSTOMER must return items in original packaging.

Article 12. Warranties

12.1 Conformity Warranty

The SELLER guarantees PRODUCTS match their description and are fit for purpose. The CUSTOMER may request repair, replacement, or refund for defects within 6 months of delivery.

12.2 Hidden Defects Warranty

The CUSTOMER may claim for hidden defects within 2 years of discovery, opting for a refund or partial price reduction.

Article 13. Liability

The SELLER is not liable for:

  • CUSTOMER’s breach of obligations.

  • Force majeure events.

  • Third-party websites linked to the WEBSITE.

Article 14. Personal Data

Data is collected to process orders and manage accounts. The CUSTOMER may opt out of marketing communications.

Under Spanish Data Protection Law (15/1999), the CUSTOMER may access, rectify, or delete data by emailing Comercial@phonecomponente.com (ID verification required).

Article 15. Cookie Policy

The WEBSITE uses cookies for browsing analytics. Users may block or delete cookies via browser settings.

Article 16. Complaints

Complaints may be submitted via phone (+34 910 029 540) or mail (C/Piedrafita, 10, 1ª Planta).

Article 17. Intellectual Property

All WEBSITE content is protected by copyright/trademark laws. Hyperlinks require prior written consent.

Article 18. Validity of General Terms

Invalid clauses do not affect the remaining terms. Unaddressed issues follow industry standards.

Article 19. Modifications

The latest version applies to new orders. Existing purchases remain under prior terms.

Article 20. Governing Law & Jurisdiction

These Terms are governed by Spanish law. Disputes shall be resolved in Spanish courts, with amicable negotiation encouraged first.


Annex 1 – Withdrawal Policy

  • Withdrawal Period14 days from delivery.

  • Notification: Email Comercial@phonecomponente.com or use the withdrawal form.

  • Refund: Issued within 14 days of return (original packaging required).

  • Exclusions: Customized/perishable items, unsealed media, etc.

Annex 2 – Delivery Policy

  • Zone: Spain only.

  • Shipping Time: Varies by PRODUCT (excludes weekends/holidays).

  • Tracking: Email confirmation sent upon dispatch.

  • Issues: Claims for damage/loss must be filed within 3 days of delivery.
